OPEN TO ALL LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA WHO ARE AT LEAST 18 YEARS OLD AS OF THE DATE OF ENTRY

Contest sponsored by Oregon Manifest, an Oregon 501(c)(4) Nonprofit Corporation, doing business as The Bike Design Project (“Sponsor”)
By entering this Contest, entrants accept and agree to be bound by these Official Rules. Any violation of these rules may result in disqualification.
All decisions of the judges regarding this Contest are final and binding in all respects.

1. CONTEST PERIOD. Contest entry period opens on May 29th 2014 12am PST and closes on July 2nd 2014 11:59pm PST, when all entries must be received (“Contest Period”).

2. ELIGIBILITY. This sweepstakes (the “Contest”) is only open to legal residents of the 50 United States and the District of Columbia who are 18 years old as of the date of entry, except officers, directors, members, affiliates and employees of the Sponsor, or any other party associated with the development or administration of this Contest (including Autodesk Inc.), and the immediate family (i.e., parents, children, siblings, spouse), and persons residing in the same household as such individuals.

3. HOW TO ENTER. Using Fusion 360 design software from Autodesk Inc., design a trophy for the winner of the 2014 Bike Design project. Using a 3-D printer, the Bike Design Project will print three copies of the winning trophy design, two of which will be provided to the winning team in the contest and one which will be given to the winner of this Contest.

You can post from within Fusion or upload a saved image of your design
We also highly encourage you to post your design to the Bike Design Project Instagram accoun.

The Bike Design Project crew will choose the winning trophy design based on criteria including appeal, relevance, and creativity. Entries must be received within the Contest Period. Entrant agrees that by entering the Contest, Sponsor may use contact information entrant provides for marketing purposes and to contact entrant regarding the Contest in accordance with applicable law. Entrant grants Sponsor, Autodesk Inc., and Advanced Sports International an unlimited, worldwide, sub-licensable, royalty free license to use, reproduce, and broadcast images of entrant’s trophy.

4. Notices and rules for participants:
Entrant’s trophy design must be new, original, and exclusively created by Entrant. Entrant’s trophy design must not contain or display material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, or otherwise infringe any third party copyright.

Entrant’s trophy design must not contain material that is inappropriate, indecent, obscene, hateful, tortious, defamatory, slanderous, libelous or otherwise objectionable. Sponsor retains sole discretion as to what constitutes inappropriate content.

Instagram is a third party corporation and has not sponsored or endorsed the Sponsor, or this Contest, and is not otherwise affiliated or associated with Sponsor or this Contest. Instagram has its own respective terms and conditions that apply to any users of its products and services. By uploading an image of Entrant’s trophy design via Instagram, entrant agrees that his or her entry conforms to Instagram photo guidelines.

5. WINNER SELECTION AND NOTIFICATION. Sponsor will choose the winning trophy design and announce the winner on July 23. Sponsor will post the winning design and may post images of runners up on Sponsor’s website and blog. The winner will be notified on July 23. Upon contacting a potential winner and determining that she or he has met all eligibility requirements of the Contest, including without limitation the execution of required waivers, publicity and liability releases and disclaimers, such individual will be declared the “winner” of the Contest.

6. PRIZE DESCRIPTION. The prize shall consist of one 3-D printed copy of the winning 2014 Bike Design Project trophy design. Approximate retail value of the prize is $200.

7. TAXES. All federal, state and/or local income and other taxes, if any, are the winner’s sole responsibility.

8. NO PRIZE TRANSFER OR SUBSTITUTION. The prize is not transferable or redeemable for cash. No substitutions for prize except by Sponsor(s), in which case a prize of equal or greater value will be substituted.

9. CONSENT AND RELEASE. By entering the Contest, each entrant releases and discharges the Sponsor and any other party associated with the development or administration of this Contest, their parent, subsidiary, and affiliated entities, and each of their respective officers, directors, members, shareholders, employees, independent contractors, agents, representatives, successors and assigns (collectively, “Sponsor Entities”), from any and all liability whatsoever in connection with this Contest, including without limitation legal claims, costs, injuries, losses or damages, demands or actions of any kind (including without limitation personal injuries, death, damage to, loss or destruction or property, rights of publicity or privacy, defamation, or portrayal in a false light) (collectively, “Claims”). Except where prohibited: (i) acceptance of a prize constitutes the consent of any winner, without further compensation, to use the name and likeness of such winner for editorial, advertising and publicity purposes by the Sponsor and/or others authorized by the Sponsor; (ii) acceptance of a prize constitutes a release by any winner of the Sponsor Entities of any and all Claims in connection with the administration of this Contest and the use, misuse, or possession of any prize; (iii) any potential winner may be required to sign an affidavit of eligibility (including social security number) and a liability/publicity release; and (iv) if prize involves travel or activities, any potential winner and travel companion (if applicable) may be required to execute releases of the Sponsor from any and all liability with respect to participation in such travel/activities and/or use of the prize. Affidavits and releases must be returned within five (5) days from the date that Sponsor first tries to notify the potential winner.

10. DISCLAIMERS. (i) Entries that are lost, late, misdirected, incorrect, garbled, or incompletely received, for any reason, will not be eligible. (ii) Sponsor, in its sole discretion, reserves the right to disqualify any person tampering with the entry process. (iii) Sponsor further reserves the right to cancel, terminate or modify the Contest if it is not capable of completion as planned, including by reason of tampering or force majeure. (iv) Sponsor Entities are not responsible for errors in the administration or fulfillment of this Contest, including without limitation mechanical, human, printing, distribution or production errors, and may modify or cancel this Contest based upon such error at its sole discretion without liability. (v) THE PRIZE IS PROVIDED “AS-IS” AND SPONSOR ENTITIES MAKE NO WARRANTIES, REPRESENTATIONS OR GUARANTEES, EXPRESS OR IMPLIED, IN FACT OR IN LAW, AS REGARDS THIS CONTEST OR THE MERCHANTABILITY, QUALITY OR FITNESS FOR A PARTICULAR PURPOSE REGARDING ANY PRIZE OR ANY COMPONENT OF ANY PRIZE. (vi) CAUTION: ANY ATTEMPT BY AN ENTRANT TO UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING WITHOUT LIMITATION ATTORNEYS’ FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

11. APPLICABLE LAWS AND JURISDICTION. This Contest is subject to all applicable federal, state, and local laws and regulations. Issues concerning the construction, validity, interpretation and enforceability of these Official Rules shall be governed by the laws of the State of Oregon. All disputes arising out of or connected with this Contest will be resolved individually, and without resort to class action, exclusively by a state or federal court located in Multnomah County, Oregon. Should there be a conflict between the laws of the State of Oregon and any other laws, the conflict will be resolved in favor of the laws of the State of Oregon. All judgments or awards shall be limited to actual out-of-pocket damages (excluding attorneys’ fees) associated with participation in this Contest and shall not include any indirect, punitive, incidental and/or consequential damages.

11. WINNER LIST. For winner’s name, send a self-addressed stamped envelope, within six (6) months of the Contest Period, to: The Bike Design Project, Trophy Design Contest, 1516 SE Tenino St., Portland, OR 97202.
