Contest sponsored by Oregon Manifest, an Oregon 501(c)(4) Nonprofit Corporation, doing business as The Bike Design Project (“Sponsor”)
By entering this Contest, entrants accept and agree to be bound by these Official Rules. Any violation of these rules may result in disqualification.
All decisions of the judges regarding this Contest are final and binding in all respects.

1. CONTEST PERIOD. Contest begins July 9th 2014 12am PST and ends July 17th 2014 11:59pm PST, when all entries must be received (“Contest Period”).

2. ELIGIBILITY. This sweepstakes (the “Contest”) is only open to legal residents of the 50 United States and the District of Columbia who are 18 years old as of the date of entry, except officers, directors, members, affiliates and employees of the Sponsor, or any other party associated with the development or administration of this Contest, and the immediate family (i.e., parents, children, siblings, spouse), and persons residing in the same household as such individuals. Void where prohibited.

3. HOW TO ENTER. Upload an inspiring photo to Instagram from your daily commute with the hashtag #urbanbikefun and @oregonmanifest in the caption. The Bike Design Project crew will choose the most interesting image. The winner will be the first to own one of the winning Oregon Manifest bikes produced by Fuji Bikes (a division of Advanced Sports International). Multiple entries allowed. Entries must be received within the Contest Period. Entrant agrees that by entering the Contest, Sponsor may use contact information entrant provides for marketing purposes and to contact entrant regarding the Contest in accordance with applicable law. Entrant grants Sponsor and Advanced Sports International an unlimited, worldwide, sub-licensable, royalty free license to use, reproduce, and broadcast entrant’s photo entry.

Enter with an Instagram Account: To enter, an entrant must be a registered user of Instagram. If an entrant is not a registered user of these sites, the entrant must visit http://instagram.com/ to register for free and download the free mobile application. Registration for and use of Instagram is subject to the Instagram terms and conditions of use. Sponsor has no responsibility with respect to such registration or use. Entries must be submitted in the formats accepted on Instagram and must be created solely by each entrant. In order for your entry to be validated, your Instagram profile settings must be public.


1. Instagram is a third party corporation and has not sponsored or endorsed the Sponsor, or this Contest, and is not otherwise affiliated or associated with Sponsor or this Contest. Creating accounts on Instagram is free. However, Instagram has its own respective terms and conditions that apply to any users of its products and services.

2. By uploading a photo via Instagram, entrant agrees that his or her entry conforms to the Photo Guidelines (defined below) and that Sponsor, in its sole discretion, may remove the entry and disqualify the entry from the Contest if Sponsor determines, in its sole discretion, that the entry fails to conform to the Photo Guidelines.


  • Entrant’s photo must not identify any individual other than entrant; and
  • Entrant’s photo must not contain material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement;
  • Entrant’s photo must not disparage Sponsor or any other person or party affiliated with the Contest;
  • Entrant’s photo must not contain images, artwork or other information that personally identifies the entrant or any other person;
  • Entrant’s photo must not contain material that is inappropriate, indecent, obscene, hateful, tortious, defamatory, slanderous, libelous or otherwise questionable. Sponsor retains sole discretion as to what constitutes inappropriate content;
  • Entrant’s photo must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; and
  • Entrant’s photo must not contain material that is unlawful, in violation of or contrary to any federal or states laws or regulations.

4. WINNER SELECTION AND NOTIFICATION. Sponsor will choose the winning photo and announce the winner on July 21st. Sponsor will post the winning photo and photos of runners up on Sponsor’s website and blog. The winner will be notified on July 21st. If the first chosen winner does not respond within 24 hours, such potential winner forfeits all rights to win the Contest or receive the prize, and an alternate potential winner may be selected. Upon contacting a potential winner and determining that he/she has met all eligibility requirements of the Contest, including without limitation the execution of required waivers, publicity and liability releases and disclaimers, such individual will be declared the “winner” of the Contest.

5. PRIZE DESCRIPTION. The prize shall consist of one production bicycle manufactured by Fuji Bikes pursuant to the 2014 Bike Design Project. Approximate retail value of the prize is $1,200.

6. TAXES. All federal, state and/or local income and other taxes, if any, are the winner’s sole responsibility.

7. NO PRIZE TRANSFER OR SUBSTITUTION. The prize is not transferable or redeemable for cash. No substitutions for prize except by Sponsor(s), in which case a prize of equal or greater value will be substituted.

8. CONSENT AND RELEASE. By entering the Contest, each entrant releases and discharges the Sponsor and any other party associated with the development or administration of this Contest, their parent, subsidiary, and affiliated entities, and each of their respective officers, directors, members, shareholders, employees, independent contractors, agents, representatives, successors and assigns (collectively, “Sponsor Entities”), from any and all liability whatsoever in connection with this Contest, including without limitation legal claims, costs, injuries, losses or damages, demands or actions of any kind (including without limitation personal injuries, death, damage to, loss or destruction or property, rights of publicity or privacy, defamation, or portrayal in a false light) (collectively, “Claims”). Except where prohibited: (i) acceptance of a prize constitutes the consent of any winner, without further compensation, to use the name and likeness of such winner for editorial, advertising and publicity purposes by the Sponsor and/or others authorized by the Sponsor; (ii) acceptance of a prize constitutes a release by any winner of the Sponsor Entities of any and all Claims in connection with the administration of this Contest and the use, misuse, or possession of any prize; (iii) any potential winner may be required to sign an affidavit of eligibility (including social security number) and a liability/publicity release; and (iv) if prize involves travel or activities, any potential winner and travel companion (if applicable) may be required to execute releases of the Sponsor from any and all liability with respect to participation in such travel/activities and/or use of the prize. Affidavits and releases must be returned within five (5) days from the date that Sponsor first tries to notify the potential winner.

9. DISCLAIMERS. (i) Entries that are lost, late, misdirected, incorrect, garbled, or incompletely received, for any reason, will not be eligible. (ii) Sponsor, in its sole discretion, reserves the right to disqualify any person tampering with the entry process. (iii) Sponsor further reserves the right to cancel, terminate or modify the Contest if it is not capable of completion as planned, including by reason of tampering or force majeure. (iv) Sponsor Entities are not responsible for errors in the administration or fulfillment of this Contest, including without limitation mechanical, human, printing, distribution or production errors, and may modify or cancel this Contest based upon such error at its sole discretion without liability. (v) THE PRIZE IS PROVIDED “AS-IS” AND SPONSOR ENTITIES MAKE NO WARRANTIES, REPRESENTATIONS OR GUARANTEES, EXPRESS OR IMPLIED, IN FACT OR IN LAW, AS REGARDS THIS CONTEST OR THE MERCHANTABILITY, QUALITY OR FITNESS FOR A PARTICULAR PURPOSE REGARDING ANY PRIZE OR ANY COMPONENT OF ANY PRIZE. (vi) CAUTION: ANY ATTEMPT BY AN ENTRANT TO UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING WITHOUT LIMITATION ATTORNEYS’ FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

10. APPLICABLE LAWS AND JURISDICTION. This Contest is subject to all applicable federal, state, and local laws and regulations. Issues concerning the construction, validity, interpretation and enforceability of these Official Rules shall be governed by the laws of the State of Oregon. All disputes arising out of or connected with this Contest will be resolved individually, and without resort to class action, exclusively by a state or federal court located in Multnomah County, Oregon. Should there be a conflict between the laws of the State of Oregon and any other laws, the conflict will be resolved in favor of the laws of the State of Oregon. All judgments or awards shall be limited to actual out-of-pocket damages (excluding attorneys’ fees) associated with participation in this Contest and shall not include any indirect, punitive, incidental and/or consequential damages.

11. WINNER LIST. For winner’s name, send a self-addressed stamped envelope, within six (6) months of the Contest Period, to: The Bike Design Project, Commute Moment Photo Contest, 1516 SE Tenino St., Portland, OR 97202.
